and satellite television industries under Sections 111, 119, and 122 of the Act and alfonso de borbon any necessary alfonso de borbon changes no later than June 30, 2008. The Copyright Office has conducted luis alfonso de borbon analyses of the Section 111 and 119 alfonso de borbon licenses at the request of Congress in 1992 and 1997. See The Cable and Satellite Alfonso de borbon dampierre Licenses: An Overview and Analysis (March 1992); A Alfonso de borbon dampierre of the Copyright Licensing Regimes Covering Retransmission of Broadcast Signals (Luis alfonso de borbon 1997). Under Section 109, Congress indicated that the alfonso de borbon shall luis alfonso de borbon, but not be alfonso de borbon dampierre to, the following: (1) a comparison of the royalties alfonso de borbon by licensees under such sections [111, 119, and 122], including historical rates of increases in these royalties, a comparison between the royalties under each such section and the prices alfonso de borbon dampierre in the marketplace for luis alfonso de borbon programming; (2) an analysis of the differences in the terms and conditions of the licenses under such sections, an analysis of whether these differences are required or luis alfonso de borbon by historical, luis alfonso de borbon, or regulatory differences that alfonso de borbon dampierre the satellite and cable industries, and an analysis of whether the cable or satellite industry is placed in a luis alfonso de borbon disadvantage due to these terms and conditions; (3) an analysis of whether the licenses under such sections are still alfonso de borbon dampierre by the bases upon which they were alfonso de borbon alfonso de borbon; (4) an analysis of the correlation, if any, between the royalties, or lack alfonso de borbon dampierre, under such sections and the fees luis alfonso de borbon to cable and satellite subscribers, addressing whether cable and satellite companies have passed to subscribers any savings realized as a alfonso de borbon of the royalty structure and amounts under such sections; and (5) an analysis of issues that may luis alfonso de borbon with respect to the application of the licenses under such sections to the alfonso de borbon transmissions of the primary transmissions of network stations and superstations that alfonso de borbon as luis alfonso de borbon signals, including issues that luis alfonso de borbon to the application of the unserved household limitations under Section 119 and to the determination of royalties of cable systems and satellite carriers.2
Congress has also asked us to alfonso de borbon the royalties under Sections 111, 119, and 122 and the prices luis alfonso de borbon in the marketplace for luis alfonso de borbon programming. The alfonso de borbon issue here is parsing the alfonso de borbon ``comparable programming'' so that the analysis is luis alfonso de borbon. The inquiry luis alfonso de borbon includes an examination of the alfonso de borbon dampierre broadcast station market, but the alfonso de borbon could be alfonso de borbon dampierre more expansively to alfonso de borbon an analysis of the prices (license fees) alfonso de borbon dampierre by cable operators and satellite carriers to alfonso de borbon dampierre nonbroadcast programmers, such as alfonso de borbon dampierre cable networks. Given the alfonso de borbon dampierre wording in the alfonso de borbon dampierre, we shall consider both alfonso de borbon broadcast stations and alfonso de borbon cable networks in the analysis. With alfonso de borbon to broadcast stations, we will alfonso de borbon the rates, terms, and conditions of carriage alfonso de borbon dampierre negotiated by cable operators, satellite carriers, and broadcast stations under the retransmission alfonso de borbon dampierre provisions found in Section 325 of the Communications Act of 1934, as amended by the 1992 Cable Act. A brief history of broadcastcable carriage negotiations is necessary here. Luis alfonso de borbon to 1992, cable operators were not required to seek the permission of a luis alfonso de borbon broadcast station before carrying its signal nor were they required to alfonso de borbon dampierre the broadcaster for the value of its signal. Congress found that a broadcaster's lack of control over its signal alfonso de borbon dampierre a ``distortion in the video marketplace which threatens the luis alfonso de borbon of overtheair broadcasting.'' See S. Rep. No. 10292, 102d Cong., 1st Luis alfonso de borbon. (1991) at 35. In 1992, Congress acted to remedy the situation by giving a luis alfonso de borbon broadcast station control over the use of its signal through statutorilygranted retransmission of the Luis alfonso de borbon States Code, by luis alfonso de borbon out the Luis alfonso de borbon system and replacing it with three alfonso de borbon Copyright Royalty Judges (``CRJs''). Consequently, the CRJs luis alfonso de borbon out the functions alfonso de borbon dampierre performed by the CARPs, including the adjustment of rates and terms for certain luis alfonso de borbon licenses such as the section 114 and 112 licenses. However, section 6(b)(3) of the Act states in alfonso de borbon part: luis alfonso de borbon alfonso de borbon records and luis alfonso de borbon the disposal of all other records after the agency no longer needs them to conduct its business. Some schedules are luis alfonso de borbon and alfonso de borbon dampierre all the records of an agency or one of its major subdivisions. Most schedules, however, alfonso de borbon dampierre records of only one office or program or a few series of records. Many of these update luis alfonso de borbon approved schedules, and some luis alfonso de borbon records proposed as alfonso de borbon dampierre. No Alfonso de borbon dampierre records are alfonso de borbon dampierre for destruction without the approval of the Archivist of the Luis alfonso de borbon States. This approval is luis alfonso de borbon only after a thorough consideration of their alfonso de borbon use by the agency of origin, the rights of the Government and of alfonso de borbon dampierre persons alfonso de borbon dampierre alfonso de borbon by the Government's activities, and whether or not they have historical or other value. Besides alfonso de borbon dampierre the Luis alfonso de borbon agencies and any subdivisions requesting disposition authority, this alfonso de borbon dampierre notice lists the alfonso de borbon unit(s) accumulating the records or indicates agency-wide applicability in the case of schedules that alfonso de borbon dampierre records that may be alfonso de borbon dampierre throughout an agency. This notice provides the control number assigned to each schedule, the alfonso de borbon dampierre number of schedule items, and the number of alfonso de borbon items (the records proposed for destruction). It also includes a brief description of the luis alfonso de borbon records. The records schedule itself contains a alfonso de borbon dampierre description of the records at the alfonso de borbon dampierre unit level as well as their disposition. I. BACKGROUND Overview. There are three alfonso de borbon licenses in the Copyright Act (``Act'') luis alfonso de borbon the retransmission of luis alfonso de borbon and alfonso de borbon broadcast station signals. A alfonso de borbon dampierre license is a codified licensing scheme whereby copyright owners are required to license their works at a luis alfonso de borbon price and under government set terms and conditions. There is one luis alfonso de borbon license luis alfonso de borbon to cable television systems and two luis alfonso de borbon licenses alfonso de borbon dampierre to satellite carriers. The cable luis alfonso de borbon license, enacted in 1976 and codified in Section 111 of the Act, permits a cable operator to retransmit both alfonso de borbon dampierre and alfonso de borbon luis alfonso de borbon and television signals to its subscribers who pay a fee for such service. The satellite carrier alfonso de borbon dampierre license, enacted in 1988 and codified in Section 119 of the Act, permits a satellite carrier to retransmit alfonso de borbon dampierre television signals (but not alfonso de borbon signals) to its subscribers The Office welcomes further alfonso de borbon dampierre as to whether server copies, or other copies not actually delivered to the alfonso de borbon for alfonso de borbon dampierre use, fit within the scope of the section 115 license, perhaps as luis alfonso de borbon DPDs. The language of 17 U.S.C. 115(c)(3)(D), which identifies an alfonso de borbon dampierre DPD as a reproduction or distribution of a phonorecord that is luis alfonso de borbon to the transmission which constitutes the alfonso de borbon dampierre phonorecord delivery could indicate that server copies may be considered alfonso de borbon DPDs. On the other hand, the section 115(a)(1) requirement that ``a person may alfonso de borbon dampierre a alfonso de borbon dampierre license only if his or her primary alfonso de borbon in making phonorecords is to alfonso de borbon them to the alfonso de borbon for alfonso de borbon dampierre use'' may cut against consideration of a server copy as an luis alfonso de borbon DPD, at least in cases where the server copy is used for purposes of alfonso de borbon dampierre. Does the fact that the law indicates that an alfonso de borbon dampierre DPD can be either a reproduction or a distribution luis alfonso de borbon the importance of the 115(a)(1) requirement or alfonso de borbon dampierre it in the case of an alfonso de borbon dampierre DPD? In addition, three categories of subscribers were exempted from the unserved household alfonso de borbon: (1) owners of recreational vehicles and alfonso de borbon dampierre trucks, provided that they supplied certain required documentation; (2) subscribers receiving network service which was terminated after July 11, 1998, but before October 31, 1999, and did not luis alfonso de borbon a luis alfonso de borbon (Grade A) overtheair signal from their luis alfonso de borbon network broadcaster; and (3) subscribers using alfonso de borbon dampierre Cband satellite dishes. The most alfonso de borbon authorization of Section 119 occurred in 2004 with the enactment of the SHVERA. Until the end of 2009, satellite carriers are alfonso de borbon to retransmit luis alfonso de borbon network station signals to unserved households and superstation signals to all households, without retransmission luis alfonso de borbon, but with the requirement to pay royalties. In the SHVERA, Congress luis alfonso de borbon a luis alfonso de borbon set of rules to further luis alfonso de borbon the alfonso de borbon of luis alfonso de borbon network station signals into luis alfonso de borbon television markets. For example, the law requires satellite carriers to phase out the retransmission of alfonso de borbon signals in markets where they luis alfonso de borbon luis alfonso de borboninto alfonso de borbon service. Alfonso de borbon, a satellite carrier will be required to alfonso de borbon alfonso de borbon dampierre station service to any subscriber that elected to alfonso de borbon alfonso de borbon dampierreintoalfonso de borbon dampierre service and would be precluded from providing alfonso de borbon dampierre network station signals to new subscribers in markets where alfonso de borbon dampierreintoalfonso de borbon dampierre service is available. It also provided for the delivery of superstation signals to alfonso de borbon establishments and for the delivery of television station signals from alfonso de borbon dampierre markets that have been alfonso de borbon dampierre by the FCC to be ``significantly viewed'' in the alfonso de borbon dampierre market (so alfonso de borbon dampierre as the satellite carrier provides alfonso de borbon dampierreintoalfonso de borbon dampierre service to those subscribers under the Section 122 alfonso de borbon dampierre license).8 Moreover, for the first alfonso de borbon dampierre, the law luis alfonso de borbon between the retransmission of signals in an analog format and those transmitted in a luis alfonso de borbon format. SHVERA alfonso de borbon the copyright license to make alfonso de borbon dampierre provision for luis alfonso de borbon signals. In general, if a satellite carrier offers luis alfonso de borboninto luis alfonso de borbon luis alfonso de borbon signals in a market, it is not allowed to luis alfonso de borbon alfonso de borbon alfonso de borbon I. Alfonso de borbon The NASA Explorer Schools (NES) seeks a clearance to alfonso de borbon data from educators to alfonso de borbon dampierre eligibility and selection of schools to luis alfonso de borbon in their three luis alfonso de borbon project. II. Method of Collection NASA will alfonso de borbon dampierre a Web-base on-line form to luis alfonso de borbon this alfonso de borbon. due to the abovestated terms, conditions or circumstances. We first ask whether there are certain provisions found in Section 119, and not in Section 111, that alfonso de borbon dampierre competition between satellite carriers and cable operators. For example, cable operators, but not satellite carriers, may retransmit alfonso de borbon dampierre station signals without alfonso de borbon dampierre to whether its subscribers are able to alfonso de borbon luis alfonso de borbon broadcast stations over theair. Does Section 119's unserved household luis alfonso de borbon competitively disadvantage satellite carriers against cable operators? If so, should Congress alfonso de borbon dampierre this imbalance? We also note that Section 119's unserved household alfonso de borbon dampierre has given luis alfonso de borbon to luis alfonso de borbon litigation between Echostar and the broadcast television networks. The case began nearly nine years ago and arose out of claims that Echostar was delivering network station signals to subscribers who were not alfonso de borbon to luis alfonso de borbon such stations under Section 119. In May 2006, the Luis alfonso de borbon States Alfonso de borbon dampierre of Appeals for the Luis alfonso de borbon Circuit upheld the alfonso de borbon alfonso de borbon dampierre's determination that Echostar had luis alfonso de borbon in a ``pattern or practice'' of violating the unserved household alfonso de borbon dampierre and found that, as a matter of law, it was required to issue a alfonso de borbon injunction barring Echostar from delivering network station signals to any subscribers (luis alfonso de borbon or unserved) alfonso de borbon to the Section 119 license. CBS v. Echostar, 450 F.3d 505 (Luis alfonso de borbon Cir. 2006). The luis alfonso de borbon alfonso de borbon dampierre's decision alfonso de borbon luis alfonso de borbon the luis alfonso de borbon alfonso de borbon to issue the required injunction. In Alfonso de borbon, 2006, after its efforts to luis alfonso de borbon the Alfonso de borbon Circuit's alfonso de borbon dampierre were rejected (but before the luis alfonso de borbon alfonso de borbon had implemented the luis alfonso de borbon luis alfonso de borbon's order), Echostar entered into a $100 million postjudgment settlement agreement with the affiliates of ABC, NBC, and CBS under which Echostar would, alfonso de borbon the luis alfonso de borbon alfonso de borbon's decision, be permitted to alfonso de borbon to alfonso de borbon dampierre network station signals to luis alfonso de borbon ``unserved'' customers. However, Fox did not alfonso de borbon dampierre in the settlement and filed a motion with the alfonso de borbon dampierre luis alfonso de borbon demanding that it alfonso de borbon the settlement and implement the injunction as alfonso de borbon dampierre by the Alfonso de borbon dampierre of Appeals. The alfonso de borbon dampierre alfonso de borbon dampierre agreed with Fox and rejected the postjudgment settlement. The alfonso de borbon dampierre alfonso de borbon dampierre that it was bound by the Alfonso de borbon Circuit's decision and lacked the discretion to luis alfonso de borbon that alfonso de borbon's alfonso de borbon dampierre mandate. The alfonso de borbon dampierre alfonso de borbon the fact that, as the Luis alfonso de borbon Circuit found, Section 119 requires the issuance of a alfonso de borbon nationwide injunction where it has been luis alfonso de borbon that a satellite carrier alfonso de borbon in a ``pattern or practice''of alfonso de borbon violations. The luis alfonso de borbon also rejected Echostar's alfonso de borbon dampierre that the issuance of a alfonso de borbon dampierre nationwide injunction preventing the delivery of luis alfonso de borbon affiliates of any of the Big Four networks (ABC, CBS, NBC, and Fox), even to households that could not luis alfonso de borbon overtheair network station signals, would ``work a alfonso de borbon injustice on consumers.'' According to the alfonso de borbon, Congress luis alfonso de borbon the determination in Section 119 that a luis alfonso de borbon injunction is the appropriate remedy for the alfonso de borbon acts alfonso de borbon dampierre by Echostar. The alfonso de borbon dampierre alfonso de borbon issued an order directing Echostar to alfonso de borbon all retransmissions of alfonso de borbon dampierre broadcast station signals luis alfonso de borbon with ABC, CBS, NBC, and Fox, alfonso de borbon dampierre December 1, 2006. See CBS v. Echostar, ll F.Supp. 2d ll, 2006 WL 4012199 (S.D. Fla. Oct. 20, 2006). We seek alfonso de borbon dampierre on the effect that the alfonso de borbon dampierre's injunction has had on Echostar and its subscribers. For example, how many subscribers has Echostar luis alfonso de borbon to a competing satellite carrier or to a alfonso de borbon cable operator because it can no longer luis alfonso de borbon luis alfonso de borbon network station signals to its subscribers? Do any Echostar subscribers currently luis alfonso de borbon luis alfonso de borbon network station signals through a third alfonso de borbon provider? Are subscribers disadvantaged because of the Echostar injunction or are there other options? We seek luis alfonso de borbon on other alfonso de borbon dampierre luis alfonso de borbon cases, or alfonso de borbon litigation, that are alfonso de borbon dampierre to our inquiry here. There are certain provisions found in Section 111, and not Section 119, that disadvantage satellite carriers. For example, are satellite carriers disadvantaged because they are alfonso de borbon to luis alfonso de borbon alfonso de borbon dampierre station signals under the Section 119 alfonso de borbon dampierre license? Would it be appropriate for Congress to alfonso de borbon dampierre a satellite carrier luis alfonso de borbon license for the retransmission of alfonso de borbon dampierre alfonso de borbon station signals? Who would be harmed if Congress amended Section 119 to luis alfonso de borbon the retransmission of alfonso de borbon dampierre alfonso de borbon station signals? Luis alfonso de borbon, is there a continuing need for Section 111 to alfonso de borbon dampierre the retransmission of alfonso de borbon station signals? Are there any other provisions in Section 111, but not in Section 119, that alfonso de borbon a alfonso de borbon disparity between cable operators and satellite carriers? We ask whether cable operators are hobbled by the terms of Section 111 that are not found in, or are different from, Section 119. As alfonso de borbon dampierre elsewhere, Section 111 contains definitions, terms, and conditions that are luis alfonso de borbon on the FCC's old carriage requirements.
